Jean Ping has introduced a new appeal to Marie Madeleine Mborantsuo. Many are wondering why go again to submit to this lady whose allegiances are known. But for this blog, this new appeal participates in the demonstration of the profound iniquity and absurdity of the decisions rendered by this court, in a context where Jean Ping needs all the supports that he can glean both internally and externally.

The lawyers of Jean Ping have noted in their brief, ridiculous anomalies both in the legal arguments, and in the figures, contained in the report of the decision of the court that gave Ali Bongo the victory. The court has no choice but to explain these anomalies and justify them. For example, what will the court say to explain how the total abstention rate of the Haut-Ogooué province is lower than that of the town of Moanda in the same province? Just on this point, the court is stuck. To justify its report, the court will have to resort to new falsehood acrobatics that could only be bigger than the previous ones. We are in the presence of an avalanche of lies from which Mborantsuo cannot extricate herself.

Mborantsuo has no choice, to justify the decision of her court, she will have to again do what she has been doing since 1993, with panache; that is to lie. And for these new lies, she will have to find new absurdities assembled from scratch; which will strengthen the position of Jean Ping on the bias of this court.

The Constitutional Court is a state institution. And democracy expects such institutions to submit to the judgment of common sense and public opinion. For the court of Mborantsuo, the conclusion has long been reached, since its role since its creation was to monarchize the presidential function in Gabon; a principle that runs counter to the presumed values of democracy. Distributing posts, property, privileges and even legal decisions to some according to their filiation, while these issues should be a matter of merit, is an insult to the very idea of justice.

It is necessary to demonstrate the penchant of this court for forfeiture and that is why we find this new appeal useful.

Jean Ping a introduit un nouveau recours auprès de Marie Madeleine Mborantsuo. Beaucoup se demandent pourquoi aller encore se soumettre à cette dame dont nous connaissons tous les allégeances. Mais pour ce blog, ce nouveau recours participe à la démonstration de la profonde iniquité et absurdité des décisions rendues par cette cour, dans un contexte où Jean Ping a besoin de tous les soutiens qu’il peut glaner en interne comme en externe.

Les avocats de Jean Ping ont relevé dans leur saisine, des anomalies ridicules aussi bien dans les arguments juridiques, que ceux chiffrés, contenues dans le rapport de la décision de la cour qui donnait Ali Bongo victorieux. La cour n’a pas le choix, mais d’expliquer ces anomalies et de les justifier. Par exemple, que dira la cour pour expliquer comment le total du taux d’abstention de la province du Haut-Ogooué se retrouve être inférieur à celui de la seule ville de Moanda, dans la même province ? Rien que sur ce point, la cour est coincée. Pour justifier son rapport, la cour va devoir recourir à de nouvelles acrobaties mensongères qui ne pourront qu’être encore plus grosses que les précédentes. Nous sommes en présence d’une avalanche mensongère dont Mborantsuo ne peut s’extirper.

Mborantsuo n’a pas le choix, pour justifier la décision de sa cour, elle va devoir s’adonner encore une fois à ce qu’elle fait depuis 1993, avec panache; c'est-à-dire mentir. Et pour ces nouveaux mensonges, il va lui falloir trouver de nouvelles absurdités montées de toute pièce ; ce qui renforcera la position de Jean Ping sur le parti-pris de cette cour.

La Cour Constitutionnelle est une institution d’Etat. Et la démocratie attend de telles institutions qu’elles se soumettent au jugement du sens commun et de l’opinion publique. Pour la cour de Mborantsuo, la cause est depuis longtemps entendue, car son rôle depuis sa création a été de monarchiser la fonction présidentielle au Gabon ; principe allant à l’encontre des valeurs présumées de la démocratie. Distribuer des postes, des biens, des privilèges et même les décisions juridiques à certains en fonction de leur filiation, alors que ces questions devraient être affaire de mérite, fait injure à l’idée même de justice.

Il faut démontrer les tocades de cette cour pour la forfaiture et c’est pourquoi nous trouvons ce nouveau recours utile.
