The French tax authorities have been hunting for years the assets of the Corsican godfather, Michel Tomi, who evokes his Gabonese nationality to hope to escape his obligations to pay taxes in France. The dispute between Michel Tomi and the French tax authorities has just been examined by the French State Council.

 

Indeed, on July 1, 2022 a tax on commissions of 1.6 million euros paid in 2012 by the French shipbuilder Raidco Marine, to Michel Tomi, was examined by the French State Council.

 

In 2019, the Administrative Court of Paris had ruled that these commissions were not subject to the French tax authorities because Michel Tomi, who has a Gabonese diplomatic passport, was therefore not subject to French taxation. He helped Raidco win a €10 million contract in Gabon in 2010, and two years later received a commission equivalent to 10% of the contract amount.

 

But thereafter, the Court of Appeal had challenged this judgment and forced Michel Tomi to pay tax in France. The judges justified their decision by the fact that Michel Tomi had real estate in Paris, where his partner and children live. It was after this judgment that Michel Tomi requested an appeal to the State Council, arguing that the Court of Appeal had ignored the Franco-Gabonese tax treaty.

 

On 1 July 2022, the State Council rejected Michel Tomi's appeal. He will therefore have to pay the tax on these commissions.

 

But in Gabon, the judicial system has no interest in this case. By the way, what is Michel Tomi's diplomatic function?

Le fisc français traque depuis des années les avoirs du parrain Corse, Michel Tomi, qui évoque sa nationalité Gabonaise pour espérer échapper à ses obligations de paiement d’impôts en France. Le litige entre Michel Tomi et le fisc français vient d’être examiné par le Conseil d’Etat français.

 

En effet, le 1er juillet 2022 un impôt sur des commissions de 1,6 million d'euros versées en 2012 par le constructeur naval français Raidco Marine, à Michel Tomi, était examiné par le Conseil d’Etat français.

 

En 2019, le tribunal administratif de Paris avait jugé que ces commissions n'étaient pas soumises au fisc français parce que Michel Tomi, qui possède un passeport diplomatique gabonais, n’était donc pas soumis à la fiscalité française. Il avait aidé Raidco à décrocher un contrat de 10 millions d'euros au Gabon en 2010, et avait perçu deux ans plus tard une commission équivalente à 10 % du montant du contrat.

 

Mais ensuite, la cour d'appel avait récusé ce jugement et astreint Michel Tomi à l'impôt en France. Les juges ont justifié leur décision par le fait que Michel Tomi disposait de biens immobiliers à Paris, où vivent sa compagne et ses enfants. C'est après ce jugement que Michel Tomi a demandé un recours devant le Conseil d'Etat, arguant que la cour d'appel avait ignoré la convention fiscale franco-gabonaise.

 

Le 1er juillet 2022, le Conseil d'Etat a débouté Michel Tomi. Ce dernier devra donc s'acquitter de l'impôt sur ces commissions.

 

Mais au Gabon, le système judiciaire ne s’intéresse nullement à ce dossier. Au fait, quelle est la fonction diplomatique de Michel Tomi ?
