The Webcor affair, what is it?

Last June, Gabon was sentenced to pay nearly 65 billion CFA francs to Webcor for breach of contract. This conviction was pronounced by the International Court of Commerce (ICC). You can read the arbitration document here.

In 2009, Webcor obtained from Libreville’s City Council and the Gabonese State, the construction contract for the new Libreville market, which was to replace the Mont-Bouët market.

Work began in August 2010 and stopped suddenly in May 2015 following a decision by the Minister of the Economy to suspend payments. After trying to settle the matter amicably, Webcor filed a complaint with the ICC for breach of contract.

In its arbitration document, the ICC has ruled in favor of Webcor, believing that the Gabonese State unilaterally broke the contract.

L’affaire Webcor, qu’est-ce que c’est ?

En juin dernier le Gabon a été condamné à verser près de 65 milliards de francs CFA à Webcor pour rupture abusive de contrat. Cette condamnation a été prononcée par la Cour de commerce internationale (CCI). Vous pouvez lire le document d’arbitrage ici.

En 2009, Webcor avait obtenu de la Mairie de Libreville et l'Etat gabonais, le contrat de construction du nouveau marché de Libreville qui devait remplacer le marché Mont-Bouët.

Les travaux démarrèrent en août 2010 puis s’arrêtèrent subitement en mai 2015, suite à une décision du ministre de l'économie de suspendre les paiements. Après avoir tenté de régler l’affaire à l'amiable, Webcor a sollicité la CCI pour rupture de contrat.

Dans sa sentence, la CCI a donné gain de cause à Webcor, estimant que l'Etat Gabonais a rompu unilatéralement le contrat.
