On a television broadcast, Gabon’s Minister of Housing, Abel Nang Ekomiye, loudly asserted that in Gabon, customary property law does not exist! It is Leon Mba who must be turning in his grave, he who, in 1938, published his Essay on Pahouin Customary Law. In this work, Leon Mba lays the academic foundations of a customary judicial system that the colonial power should take into account and fully integrate into the judicial system of French Equatorial Africa.

 

It is ironic to note that in 2021, a true Gabonese would come to deny the existence of customary jurisprudence on land ownership in Gabon. But we offer you for reading, a work published in 2015, which contradicts Mr. Abel Nang Ekomiye. In this document, you will see that texts do exist in Gabon which allow customary law to be incorporated into property.

Lors d’une émission télévisée, le ministre Gabonais de l’Habitat, Abel Nang Ekomiye, a affirmé haut et fort qu’au Gabon, le droit coutumier de propriété n’existe pas ! C’est Leon Mba qui doit se retourner dans sa tombe, lui qui, en 1938, publia son Essai de Droit Coutumier Pahouin. Dans cet ouvrage, Leon Mba pose les bases académiques d’un système judiciaire coutumier dont la tutelle coloniale devrait tenir compte et intégrer à part entière dans le système judiciaire de l’Afrique Equatoriale Française.

 

Il est ironique de constater qu’en 2021, un Gabonais pure jus vienne nier l’existence d’une jurisprudence coutumière en matière de propriété foncière au Gabon. Mais nous vous offrons en lecture un travail publié en 2015, qui vient contredire monsieur Abel Nang Ekomiye. Dans ce document, vous constaterez que des textes existent bel et bien au Gabon, qui permettent au droit coutumier de s’insérer dans la propriété.
