In Gabon, the Constitution theoretically provides that all citizens are equal before the law and are entitled to equal protection under that law. Indeed, the law must apply in a uniform way to everyone, without particularity.

 

Nevertheless, jurists and lawyers, because of the sensitivity of their profession, are entitled to special treatment before the law. Of course, a lawyer can be prosecuted in accordance with the law like everyone else; but to initiate such a public action against a lawyer, it is necessary to have an authorization given by the Public Prosecutor, who themselves are required to inform the President of the Bar Association.

 

Dear readers, therefore, understand that the lawyer enjoys a certain privilege given the profession they practice in their capacity as auxiliary of the justice system. Consequently, judicial police officers do not have the right to arrest and interview a lawyer without an order from the competent judicial authorities, which include the President of the Bar Association.

 

A lawyer may be detained and placed under arrest warrant only when this procedure has been followed. But as the lawyers explain in the video above, a member of the Gabonese bar association was reportedly arrested in flagrant violation of both administrative and legal provisions. This is unacceptable and therefore constitutes an unlawful arrest.

Au Gabon, la Constitution prévoit théoriquement que tous les citoyens soient égaux devant la loi et aient droit à une égale protection sous cette loi. En effet, la loi doit s’appliquer d’une manière uniforme à tout le monde, sans particularité.

 

Néanmoins, les juristes et avocats, du fait de la sensibilité de leur profession, ont droit à un traitement particulier devant la loi. Bien entendu, un avocat peut être poursuivi conformément à la loi comme tout le monde ; mais pour déclencher une telle action publique contre un avocat, il faille nécessairement une autorisation donnée par le Procureur de la République, qui lui-même est tenu d’en informer le Bâtonnier de l’Ordre des avocats.

 

Chers lecteurs, comprenez donc que l’avocat jouisse d’un certain privilège vu la profession qu’il exerce en sa qualité d’auxiliaire de justice. Par conséquent, les officiers de police judiciaire n’ont pas qualité d’aller arrêter et auditionner un avocat, sans un ordre des autorités judiciaires compétentes qui incluent le Bâtonnier.

 

L’avocat ne peut être arrêté et placé sous mandat d’arrêt que lorsque cette procédure a été respectée. Mais comme l’expliquent les avocats dans la vidéo ci-dessus, un membre du barreau gabonais aurait été arrêté en violation flagrante des dispositions aussi administratives que légale. Cela est inacceptable et cela constitue donc une arrestation illégale.
