THE BITAM BABY’S CASE: WHAT DOES GABON’S CIVIL CODE SAY ABOUT THE ADOPTION OF CHILDREN? L’AFFAIRE DU BÉBÉ DE BITAM : QUE DIT LE CODE CIVIL GABONAIS À PROPOS DE L’ADOPTION D’ENFANTS?

Dear readers, many of you have asked for our opinion on the case of the Bitam’s kidnapped baby, who has fortunately been returned to the birth mother.

This blog would not like to repeat the case, because some Gabonese activists whom we respect, have already widely and brilliantly communicated on the subject.

This blog intervenes here on two points:

1. The Gabonese Republic has not yet ratified the Hague Convention of 29 May 1993 on the protection of children and international cooperation in matters of adoption. This simply means that international law regarding the protection of children during adoption has no applicability in Gabon. This state of affairs is shocking and sad to note, but it is the choice of the Bongo regime not to sufficiently protect our children in the face of all the risks of predation that threaten them.

2. In matters of adoption, Gabon depends simply and solely on its penal code, the articles of which are shown to you above.

It's up to you to get your own idea of why so many disfunctions in this area in our country.

Chers lecteurs, vous avez été nombreux à solliciter notre opinion sur l’affaire du bébé séquestré de Bitam, qui a été heureusement rendu à sa mère biologique.

Ce blog ne voudrait pas faire de la redite, car certains activistes Gabonais que nous respectons ont déjà largement et brillamment communique sur le sujet.

Ce blog vient ici intervenir sur deux points :

1. La République Gabonaise n’a pas encore ratifié la convention de La Haye du 29 mai 1993, portant sur la protection des enfants et la coopération internationale, en matière d’adoption. Ceci veut tout simplement dire que le droit international en matière de protection des enfants pendant l’adoption, n’a aucune applicabilité au Gabon. Cet état de fait est choquant et triste à constater, mais c’est le choix du régime Bongo de ne pas protéger suffisamment nos enfants devant tous les risques de prédation qui les menacent.

2. En matière d’adoption, le Gabon dépend simplement et uniquement de son code pénal dont les articles vous sont montrés ci-dessus.
