What is an "institution"?

The legal definition given by political scientists can be summarized as follows:

"An institution is an organization whose status and functioning are governed by the law, and resulting in the strengthening of an organized and stable system around which political, economic and social activities are organized.

A "public" institution therefore falls under the State and is based on the expression of the law; meaning that it is governed by the law as to its organization and operation. It is not an organization based on private individuals, whether moral or physical, whose appointments are based on private relations between individuals.

Dear readers, when we are aware of the above, is the Constitutional Court a state institution "as we understand it" in Gabon?

Qu’est-ce qu’une « institution » ?

La définition juridique qu’en donnent les politologues peut se résumer comme suit :

« Une institution est un organisme dont le statut et le fonctionnement sont régis par le Droit, et résultant au renforcement d’un système organisé et stables autour duquel s’organisent les activités politiques, économiques et sociales.

Une institution « publique » relève donc de l’Etat et repose sur l’expression du droit ; c’est-à-dire qu’elle est régie par le droit quant à son organisation et son fonctionnement. Il ne s’agit donc pas d’une organisation reposant sur des personnes privées, qu’elles soient morales ou physiques, dont les nominations relèvent de relations privées entre particuliers.

Chers lecteurs, quand on a conscience de ce qui précède, la Cour Constitutionnelle est-elle une institution d’Etat « comme on l’entend » au Gabon ?

On ne lâche rien !
