Violation of freedom of the press in Gabon following the sentencing of the publication director of the newspaper "L’Aube (the Dawn)" Alphonse ONGOUO

The reaction of the Gabonese Civil Society

The scale, symbol of justice refers to the equilibrium, objectivity and fairness. However, the first magistrate of the Republic of Gabon, by virtue of his function, enjoys an immunity which shields him from prosecution and instead immediately places him asymmetrically against other litigants.

This immunity is the equivalent of a veto. From this point of view, the Head of State, by virtue of his function is basically a model of morality, cannot use his privileged position and abuse his immunity by frequently suing all-out his fellow citizens who do not have, the opportunity to defend themselves during trials in which the adversarial process is nonexistent.

The instrumentalization of a judicial system at the order of the regime, to punish opponents condemned in advance is the antithesis of democracy and any impartial justice system, that is independent and rendered in principle in the name of the Gabonese people. It is with these considerations that we wish to strongly express our outrage at what can be described as harassment, intimidation and terrorism by the Chief Executive Ali Bongo Ondimba, against the entire private press and particularly the OLOUMAMBE communication group of which Mr. Alphonse ONGOUO is responsible, also the political leaders and the civil society, very critical of his magisterium marked by a disastrous handling of public affairs.

Repeated trials with the aim to program the bankruptcy of papers like "La Loupe" and "L’Aube" are organized against a press that serves the pluralistic democracy.

Atteinte à la liberté de la presse au Gabon suite à la condamnation du Directeur de publication du journal « l’Aube » Alphonse ONGOUO

Réaction de la Société civile Gabonaise

La balance, symbole de la Justice fait référence à l’équilibre, à l’objectivité et à l’équité. Or, le premier magistrat de la République gabonaise, de par sa fonction, jouit d’une immunité qui le met à l’abri de poursuites judiciaires et le place d’emblée en position asymétrique vis à vis d’autres justiciables.

Cette immunité est l’équivalent d’un véto. De ce point de vue, le Chef de l’État qui, par sa fonction est en principe un modèle de moralité, ne peut utiliser sa position privilégiée et abuser de son immunité pour ester fréquemment en justice tous azimuts contre ses concitoyens qui n’ont pas eux, la possibilité de se défendre au cours des procès où le principe du contradictoire est inexistant.

L’instrumentalisation d’une justice aux ordres pour châtier ses adversaires condamnés d’avance est aux antipodes de la démocratie et toute justice impartiale, indépendante rendue en principe au nom du peuple gabonais. C’est fort de ces considérations que nous tenons à exprimer fortement notre indignation face à ce qu’il peut être qualifié de harcèlement, d’intimidation et de terrorisme du Chef de l’exécutif Ali BONGO ONDIMBA contre l’ensemble de la presse privée , et particulièrement du groupe de communication OLOUMAMBE dont Monsieur Alphonse ONGOUO est responsable, puis les leaders politiques et de la Société civile, très critique de son magistère marquée par une gestion catastrophique de la chose publique.

Des procès à répétition avec pour objectif de programmer la faillite des journaux tels que « La Loupe » et « L’aube », sont organisés contre une presse qui sert la démocratie plurielle.
