WHAT IS MBORANTSUO’S ROLE ? QUEL EST LE RÔLE DE MBORANTSUO ?

If the Constitutional Court set up in Gabon in the 1990s was inspired by the French model of constitutional justice; this inspiration was simply limited to bureaucratic mimicry because the foundations of true constitutional jurisprudence have never been duplicated under our tropics.

Mborantsuo was put at the head of this Court in the same way that Omar Bongo appointed his relatives to sensitive posts in the Gabonese state and institutional apparatus; to guarantee that these people would help him to perpetuate his regime.

Mborantsuo used her Constitutional Court to the point of caricature, to perpetuate the power of those who put her there. Mborantsuo's decisions are dictated by the sole desire to strengthen and thus perpetuate this regime. Therefore, any Gabonese who would seek justice by going to Mborantsuo should be likened to an ox that helps the butcher sharpen his knives.

The principle of the primacy of the constitution over any other consideration does not exist for Mborantsuo because she can unilaterally modify this constitution to make legal a constitutional breach that would allow the regime she protects to continue over time. We have just had once again the proof of that.

Knowing that he was at the head of an inveterate dictatorship, having to concede the introduction of multiparty system to the Gabonese people, Omar Bongo ensured that he had a judicial body controlling the legislative power in relation to constitutional norms, and judging elections and referendum, which would be fully devoted to him. He placed one of his mistresses at its head, for one is never better served than by themselves.

Dear readers, as was to be expected, the results of this constitutional court were very disappointing but predictable. Indeed, how could a constitutional court be effective and indeed efficient, in a system marked by the existence of an omnipotent head of state who also shared the bed of the President of this Constitutional Court?

Who can be really surprised at the situation that prevails today?

Si la Cour Constitutionnelle mise en place au Gabon dans les années 1990 s’est inspirée du modèle français de justice constitutionnelle ; l’inspiration s’est limitée simplement au mimétisme bureaucratique car les fondements d’une jurisprudence constitutionnelle véritable n’ont jamais été dupliqués sous nos tropiques.

Mborantsuo a été placée à cette Cour de la même façon qu’Omar Bongo avait placé ses parents à des postes sensibles dans l’appareil étatique et institutionnel gabonais ; pour garantir que ces gens l’aideraient à pérenniser son pouvoir.

Mborantsuo s’est servie de sa Cour Constitutionnelle jusqu’à la caricature, pour éterniser le pouvoir de ceux qui l’y ont placée. Les décisions de Mborantsuo sont dictées par l’unique désir de renforcer et donc de pérenniser ce pouvoir. Par conséquent, tout Gabonais qui irait chercher justice chez Mborantsuo devrait être assimilé à un bœuf qui aide le boucher à aiguiser ses couteaux.

Le principe de la primauté de la constitution sur toute autre considération n’existe pas pour Mborantsuo car elle peut modifier unilatéralement cette constitution pour rendre légale une entorse constitutionnelle qui permettrait au régime qu’elle protège de perdurer dans le temps. Nous venons encore d’en avoir la preuve.

Se sachant être à la tête d’une dictature invétérée, devant concéder l’instauration du multipartisme au Gabonais, Omar Bongo s’assura de disposer d’un organe juridictionnel chargé de contrôler le pouvoir législatif par rapport aux normes constitutionnelles, et être juge des élections et référendum, qui lui soit totalement acquis. Il y plaça une de ses maitresses, car on n’est jamais mieux servi que par soit même.

Chers lecteurs, comme il fallait s’y attendre, les résultats de cette juridiction constitutionnelle furent fort décevants mais prévisibles. Comment en effet, une justice constitutionnelle pouvait-elle être effective, voire efficace, dans un système marqué par l’existence d’un chef d’Etat omnipotent qui en plus partageait le lit de la Présidente de cette Cour Constitutionnelle ?

Qui peut être réellement surpris de la situation qui prévaut aujourd’hui ?
