DOES THE ALI BONGO REGIME HAVE COMPETENT LAWYERS? LE RÉGIME ALI BONGO A-T-IL DES JURISTES COMPÉTENTS?

On Saturday, 8 November 2014, the Embassy of Gabon in France released a statement informing the public opinion of the intention of the Gabonese government to sue journalist Pierre Péan because of the content of his latest book, "Nouvelles Affaires Africaines." This press release, we repeat, is not a lawsuit, but an announcement that there will be one. The statement is not very explicit about the possible charges, but from its content, the following two complaints can be detected:

1. Defamatory Remarks by Pierre Péan in his book.

2. Attempt by Pierre Péan to interfere in the future presidential election of 2016.

The problem with this statement is that the people who wrote it at the Embassy of Gabon in France, know nothing about the law. Indeed, dear readers, the book by Pierre Péan is talking about all kinds of malfeasance by Ali Bongo, Omar Bongo, and various individuals in the apparatus of the State of Gabon, but it is never a question of slandering Gabon. The people who wrote this statement unfortunately have their mind calcified by the confiscation of power by the Bongos in Gabon, to the point of not being able to tell the difference between the Bongo family and Gabon. If Pierre Péan demonstrates the extent of the fraud that is Ali Bongo, it is not for Gabon to launch a lawsuit against the journalist, but for Ali Bongo to do so. Gabon is a nation, not an individual or a family. Ali Bongo forfeitures must be dealt by Ali Bongo and not by Gabon.

To clarify those whose brains cannot separate the Bongos from Gabon, we give you the example of the Bettencourt affair in France, while Nicolas Sarkozy was President. Although this case quickly became a matter of state which threatened to take down the incumbent President of France, the French state at no time to cause for Sarkozy because the facts alleged against him had been committed by him and he was the one who had to answer. Similarly, when the American billionaire Donald Trump asked Barack Obama to publicly present his birth certificate, the US government did not intervene against Donald Trump, because it was Obama who was being questioned as an individual and not the US government. Dear readers, you understand that when the Embassy of Gabon announced that the Gabonese government would file a complaint, we are entitled to ask in the name of what and on whose behalf? We have Areva causing irreversible devastation to rural populations of Haut-Ogooué; the protective function of the State towards its people demanded that Gabon sued Areva before international institutions. But to date, Gabon has never shown the slightest interest in this regard. But when Pierre Péan published a book showing Ali Bongo to be an impostor, the State stepped up to the plate Pavlovianly. Ridiculous! It is Ali Bongo and his family who should file a complaint against Pierre Péan; Gabon's government has other fish to fry.

About the second recrimination contained in the press release of the Embassy, it is better to laugh about it, because who does not remember that in 2009, Robert Bourgi had ostentatiously interfered in the Gabonese presidential election, making statements in the media that Ali Bongo was his candidate and that given his influence on Sarkozy, people could deduce that he was also Sarkozy’s candidate. If the Embassy of Gabon prohibits Pierre Péan from being interested in Gabon, should we conclude that the only "foreigners" who would be allowed to have an interest in Gabon, would be those who support Ali Bongo with the last zeal? You see dear readers, this recrimination that has no legal merit. Pierre Péan has the right to be interested in Gabon, to investigate there and publish his findings.

Since the facts alleged by Péan are concurrent with those of several others, the question to Ali Bongo is to produce the original documents proving his identity, and to seamlessly shed light on the graft he is making on the treasury. Contribute one’s side of the truth in a trial is a democratic and republican principal that the French justice systems allows to all parties. Each party organizes their defense accordingly, here the parties should be Pierre Péan one side and Ali Bongo on the other. Gabon is not a party against Péan.

Le Samedi 8 Novembre 2014, l'ambassade du Gabon en France a rendu public un communiqué informant l'opinion de l'intention de l'Etat gabonais de porter plainte au journaliste Pierre Péan, à cause du contenu de son dernier livre, "Nouvelles Affaires Africaines". Ce communiqué, nous le répétons, n'est pas une plainte, mais une annonce qu'il va y avoir une plainte. Le communiqué n'est pas très explicite au sujet des éventuels chefs d'accusation, mais on peut déceler dans son contenu, les deux récriminations suivantes:

1. Propos diffamatoires tenus par Pierre Péan dans son livre.

2. Tentative de Pierre Péan de s'immiscer dans la future élection présidentielle de 2016.

Le problème avec ce communiqué, est que les gens qui l'ont écrit à l'ambassade du Gabon en France, ne connaissent absolument rien du droit. En effet, chers lecteurs, le livre de Pierre Péan parle des maraudages en tout genre d'Ali Bongo, d'Omar Bongo, de divers individus dans l'appareil de l'Etat gabonais, mais il n'est jamais question de diffamer le Gabon. Les gens qui ont écrit ce communiqué ont malheureusement l'esprit calcifié par la confiscation du pouvoir au Gabon par les Bongo, au point de ne plus être en mesure de faire la différence entre la famille Bongo et le Gabon. Si Pierre Péan démontre l'ampleur de l'imposture d'Ali Bongo, ce n'est pas au Gabon de porter plainte contre le journaliste, mais à Ali Bongo de le faire. Le Gabon est une nation, et non un individu ou une famille. Les forfaitures d'Ali Bongo doivent être du ressort d'Ali Bongo et non du Gabon.

Pour mieux éclairer ceux dont la cervelle ne parvient pas à séparer le Gabon des Bongo, nous vous donnons l'exemple de l'affaire Bettencourt en France, du temps où Nicolas Sarkozy en était le Président. Même si cette affaire devint rapidement une affaire d’Etat qui menaçait d'emporter le Président en exercice de la France, l'Etat français n'a à aucun moment, pris parti et cause pour Sarkozy, car les faits qui lui étaient reprochés n'engageaient que lui et il était le seul qui devait en répondre. De manière similaire, lorsque le milliardaire Américain Donald Trump avait demandé à Barack Obama de présenter publiquement son acte de naissance, l'Etat américain n'intervint pas en s'insurgeant contre Donald Trump, car c'est Obama qui était interpellé en tant qu’individu et non l'Etat américain. Chers lecteurs, vous comprenez donc que lorsque l'ambassade du Gabon annonce que l'Etat gabonais va déposer une plainte, nous sommes en droit de nous demander au nom de quoi et de qui? Nous avons Areva qui a causé des ravages irréversibles aux populations paysannes du Haut-Ogooué; la mission protectrice de l'Etat envers ses populations exigeait que le Gabon poursuivre Areva auprès des institutions compétentes internationales. Mais à ce jour, le Gabon n'a jamais manifesté le moindre intérêt dans ce sens. Mais quand Pierre Péan publie un livre démontrant qu'Ali Bongo soit un imposteur, l'Etat monte au créneau de manière pavlovienne. Le ridicule! C'est Ali Bongo et sa famille qui devraient porter plainte à Pierre Péan; l'Etat gabonais a d'autres chats à fouetter.

A propos de la deuxième récrimination contenue dans le communiqué de l'ambassade, il est préférable d'en rire, car qui ne se souvient pas qu'en 2009, Robert Bourgi s'était immiscé dans l'élection présidentielle gabonaise de manière ostentatoire, faisant des déclarations médiatiques sur le fait qu'Ali Bongo était son candidat et qu'étant donné son influence sur Sarkozy, on pouvant déduire qu'il était aussi le candidat de Sarkozy. Si l'ambassade du Gabon interdit à Pierre Péan de s'intéresser au Gabon, doit-on en conclure que les seuls "étrangers" à qui il serait permis de s'intéresser au Gabon, sont ceux qui soutiennent avec le dernier zèle Ali Bongo? Vous comprenez chers lecteurs, que cette récrimination n'a aucun mérite juridique. Pierre Péan a le droit de s'intéresser au Gabon, d'y faire des investigations et de publier ses trouvailles.

Puisque les faits allégués par Péan sont concomitants à ceux de plusieurs autres personnes, la question qui se pose à Ali Bongo est celle de produire les documents originaux attestant de son identité, et de faire en toute transparence la lumière sur les ponctions de trésorerie dont il se rend coupables. Apporter sa part de vérité dans un procès est un droit démocratique et républicain que la justice française permet à toutes les parties. Chacune des parties organise sa défense et ici, les parties devraient être Pierre Péan d'un côté et Ali Bongo de l'autre. Le Gabon n'est pas la partie se présentant contre Péan.

Chers lecteurs, quand des amateurs arrivistes, munis de faux diplômes, sont au pouvoir, cela donne ce spectacle folklorique! Y a-t-il un pilote dans l'avion?
