In the program “Débat du jour" by Christopher Boisbouvier on RFI (Radio France Internationale), the Spokesman of the Gabonese Presidency, Alain Claude bile bi Nzé released a new humorous trial balloon in his frantic race to try to defend Ali Bongo’s multiform forfeiture.

Commentary by Annoying Gabon: Alain Claude Bilié bi Nzé is spouting nonsense. In our last post we already talked about the incompetence of the lawyers who are advising the communicators of the Presidency of the Republic of Gabon; we have again the evidence of this in the nonsense by Bilié bi Nzé. First, a birth certificate cannot be changed. It's the law. Everyone has one birth and therefore has a birth certificate which must include the name of the person at their birth, the place of birth and the parents recognized at this birth. For people whose birth is not well documented for various reasons, they have delivered to them by the court, after a thorough investigation and corroborating evidence, what is called a “judicial document of birth”. This document is not a birth certificate, but an identity document that gathers as much information as possible about the origins of an individual. In the case of Ali Bongo, it is a birth certificate that he presented in his application in 2009. This birth certificate must have been consistent with the identity of Ali Bongo and of his parents at the time of birth and not in 2009. Let us introduce you to the Gabonese jurisdiction that shatters Bilié bi Nzé pitiful trial balloon:

The Civil Code of Gabon, in Chapter II, Section 2 which deals with birth certificates, states in its Article 167: "The birth certificate states the date, location and, if possible, the time of birth, sex, the full names of the child. The names, ages, birthplaces, occupations and addresses of the parents and, if applicable, the names, professions and residence of the registrant." In Article 175 it is said: "The copy of the birth certificate or judgment in lieu thereof shall be issued to the person concerned, their representative, as well as the Prosecutor of the Republic and for minors, to their parents or guardian. In case of absence or after the death of a person, the copy of their birth certificate or judgment in lieu may also be issued to the spouse, ascendants or lineal descendants."

Regarding the change of names, the Gabonese Civil Code states in its Article 103: "The change of names or adding a name to a person may be authorized by the President of the court of the domicile of the applicant, if there is just cause. Mention of this change or addition should be made besides the birth certificate of the individual."

Dear readers, you read above the Gabonese Civil Code and there are two basic points to remember:

1. Only Ali Bongo or someone authorized by him is entitled to apply for a conformed copy of his birth certificate, and to receive it once established. The term "conformed copy" means that the copy is identical in every respect to the original. Therefore, if as Alain Claude Bilié bi Nzé asserts, the anomalies in Ali Bongo’s birth certificate are the responsibility of the registrar, why then did Ali Bongo agree to withdraw a "conformed copy" of his birth certificate that was not in keeping with the original and included gross abnormalities, included it in his application; which was then validated by Marie Madeleine Mborantsuo and company; then when Luc Bengone Nsi filed its action, the same chain of individual auditors said that everything was in order in this birth certificate; and it is only today that suddenly you say that it is the registrar who made mistakes. How should we to interpret this comedy? So Ali Bongo knew nothing of his own birth to the point of not being able to differentiate the appropriate information? Really, Mr. Bilié bi Nzé, is that your justification? Pierre Péan is going to have fun at your expense in the courts!

2. As stated in Article 103 of the Civil Code of Gabon, changes of names and surnames are to be made besides the birth certificate. That is to say that the first or last name one has at birth is never lost in the birth certificate, but new names and surnames are added in related documents. This means that the name Alain should always appear on all of Ali Bongo birth certificates, if that was his name at birth. It is not possible to make someone’s identity at birth disappear from their birth certificate and replace it with a new identity. This is to say that the change of Alain to Ali and the addition of Ondimba, would not have had any impact on the mention of Alain Bongo as first and last name at birth by Caesarean section to a sterile mother in Brazzaville during an imaginary civil war.

Dans l’émission «Débat du jour» de Christophe Boisbouvier, sur RFI (Radio France Internationale), le Porte-Parole de la Présidence de la République, Alain Claude Bilié bi Nzé a lâché un nouveau ballon d’essai humoristique, dans sa course effrénée à vouloir défendre la forfaiture multiforme d’Ali Bongo.

Dans cette émission donc, à la question suivante posée: «En mai 2009, le futur candidat Ali Bongo produit un acte de naissance où il est écrit « Ali Bongo Ondimba », alors qu’il n’a adopté le prénom Ali que bien plus tard dans sa vie. Pourquoi cette anomalie ? »

Alain Claude Bilié bi Nzé a répondu: « Monsieur Ali Bongo Ondimba n’est pas l’officier d’état civil qui a rédigé son acte de naissance. Donc si une question comme cela se pose, qu’on la pose à l’officier d’état civil qui a rédigé cet acte de naissance. A deux reprises au moins dans sa vie, [Ali Bongo] a dû procéder à des ajouts dans son acte de naissance pour des raisons évidentes : la conversion à l’islam et plus tard, l’ajout du patronyme Ondimba au nom global de cette famille Bongo. Celui qui estime que cet acte de naissance n’a pas été élaboré et retranscrit sans les formes s’en prend à l’officier d’état civil et non à la personne. Ce n’est pas vous-même à votre naissance qui rédigez votre acte de naissance. »

Commentaire de Gabon Enervant: Alain Claude Bilié bi Nzé débite des âneries. Dans notre dernier billet, nous parlions déjà de l’incompétence des juristes qui conseillent les communicateurs de la Présidence de la République Gabonaise; nous en avons encore la preuve par ces idioties de Bilié bi Nzé. Premièrement, un acte de naissance ne se change pas. C’est la loi. Toute personne n’a qu’une naissance et par conséquent n’a qu’un acte de naissance qui doit comporter le nom de cette personne à sa naissance, le lieu de cette naissance et les parents reconnus à cette naissance. Pour des gens dont la naissance n’est pas bien documentée pour diverses raisons, il leur ai délivré par les tribunaux, après une enquête approfondie et des éléments concordants, ce qu’on appelle un jugement supplétif. Ce document dit jugement supplétif n’est pas un acte de naissance, mais un document d’identité permettant de rassembler le plus d’informations sur les origines d’un individu. Dans le cas d’Ali Bongo, c’est bien un acte de naissance qu’il a présenté pour son dossier de candidature en 2009. Cet acte de naissance devait être conforme à l’identité d’Ali Bongo et à celle de ses parents, à sa naissance et non en 2009. Permettez-nous de vous présenter toute la juridiction gabonaise qui fait éclater le piteux ballon d’essai de Bilié bi Nzé:

Le Code civil du Gabon, dans son chapitre II, Section 2 qui traite des actes de naissances, dit ceci dans son Article 167: « L’acte de naissance énonce la date, le lieu et si possible, l’heure de la naissance, le sexe, les prénoms et noms de l’enfant. Les prénoms, noms, âges, lieux de naissance, professions et domicile des père et mère et, s’il y a lieu, les noms, prénoms, professions et domicile du déclarant. » Dans l’Article 175 il est dit: « La copie conforme de l’acte de naissance ou du jugement en tenant lieu ne peut être délivrée qu’à la personne concernée, au mandataire de cette dernière, ainsi qu’au Procureur de la République, et pour les mineurs, à leur père et mère ou tuteur. En cas d’absence ou après la mort d’une personne, la copie conforme de son acte de naissance ou du jugement en tenant lieu peut être également délivrée au conjoint, aux ascendants ou descendants en ligne directe.»

Concernant le changement de noms, le Code Civil Gabonais dit ceci dans son Article 103: «Le changement de prénoms ou l’adjonction d’un prénom pour une personne peut être autorisé par le Président du tribunal du domicile du demandeur, s’il y a eu juste motif. Mention de ce changement ou de cette adjonction doit être faite en marge de l’acte de naissance de l’intéressé

Chers lecteurs, vous avez lu ci-dessus le Code Civil gabonais et il y a deux choses fondamentales à retenir:

1 Seul Ali Bongo ou quelqu’un mandaté par lui est autorisé à déposer une demande de copie conforme de son acte de naissance, et à la recevoir, une fois établie. Le terme « copie conforme » signifie que la copie est identique à tout point de vue à l’original. Par conséquent, si comme Alain Claude Bilié bi Nzé l’affirme, les anomalies constatées dans l’acte de naissance d’Ali Bongo sont la responsabilité de l’officier d’état civil, comment expliquer qu’Ali Bongo ait accepté de retirer une « copie conforme » de son acte de naissance qui n’était aucunement conforme à l’original et comportait de grossières anomalies, l’a introduite dans son dossier de candidature ; dossier qui a été validé par Marie Madeleine Mborantsuo et compagnie; puis quand Luc Bengone Nsi a déposé son recours, la même chaine d’individus vérificateurs a dit que tout était conforme dans cet acte de naissance; et c’est aujourd’hui que subitement, vous venez dire que c’est l’officier d’état civil qui a fait des erreurs. Comment devons-nous interpréter cette comédie? Donc Ali Bongo ne savait rien de sa propre naissance au point de ne pouvoir différencier la conformité des informations fournies? Vraiment, monsieur Bilié bi Nzé, c’est cela votre justification? Pierre Péan va s’amuser à vos dépends dans les tribunaux!

2 Comme le dit l’Article 103 du Code Civil gabonais, les changements de noms et prénoms se font en marge de l’acte de naissance. C’est à dire que le nom ou le prénom qu’on a eu à la naissance ne se perdent jamais dans l’acte de naissance, mais on ajoute les nouveaux noms et prénoms dans des documents annexes. C'est-à-dire que le prénom Alain devrait toujours apparaitre sur tout acte de naissance d’Ali Bongo, si tel était son prénom à la naissance. On ne peut pas faire disparaitre l’identité à la naissance sur un acte de naissance, et la remplacer par une nouvelle identité. Ceci pour dire que le changement d’Alain en Ali et l’ajout d’Odimba, n’auraient dû avoir aucun impact sur la mention d’Alain Bongo comme nom et prénom à la naissance par césarienne à Brazzaville d’une mère stérile en pleine guerre civile imaginaire.

Chers lecteurs, ce ballon d’essai d’Alain Claude Bilié bi Nzé est à ajouter à la collection déjà très fournie d’explications bizarres, qui se mordent la queue, pour essayer de justifier ce qui est de toute évidence un faux document. Ils se feront pulvériser au tribunal en un rien de temps!
