Introductory remarks

PANORAMA OF THE SOCIO-POLITICAL CLIMATE IN GABON

Since the death of President Omar Bongo Ondimba in June 8, 2009 and the special elections of August 2009, the socio-political climate in Gabon has continued to deteriorate due to the clearly expressed will of the Gabonese Democratic Party (PDG, in power) to confiscate power and impose a monarchical vision in defiance of the rule of law and the sovereignty of the Gabonese people. All the critical mass of Gabon has been constantly sounding the alarm about the major risks that this poses to the country. The PDG's refusal to abide by the rules of the democratic game manifests itself through poor organization of all elections. With a turnout of less than 15%, the legislative election in December 2011 did not deviate from this rule. Rather, they resulted in the establishment of a monochromatic national assembly where of one hundred and twenty (120) members, the PDG alone has 114.

THE POLITICAL, ECONOMIC AND SOCIAL CONDITIONS CONTINUE TO DETERIORATE IN GABON

Being delegated to exercise the national sovereignty, the Constitutional Court has, for almost three (3) years, illustrated itself with a zeal rarely achieved, with specious and partisan interpretations of the law in order to facilitate the control of Power and of the State apparatus by the PDG. The Constitutional Court has acted as a specialized agency of the PDG by validating, two months before the last legislative elections, a law that requires every dissident wanting to be a candidate for an election to declare it six (6) months in advance. In validating a law which provides that leaders of a dissolve party cannot create another one before five (5) years, she has deliberately chosen to deprive some compatriots of their political rights and to remove the competition any person who could be threatening for the PDG. The renewal for a fourth term of seven (7) years of Mrs. Mborantsuo, also stepmother to Ali Bongo, at the head of that institution does not bode well for the entrenchment of democratic values and the fairness of the upcoming elections.
Observers of politics and all of the Gabonese population which already gravely questioned the ability of this regime to govern well are now convinced that Gabon is not governed, but hijacked by a clan that seriously jeopardizes its future. The main measures taken by the authority are in line with the personalization of power and the negation of democratic principles.

- Revision of the Constitution to unilaterally strengthen the powers of the President of the Republic;
- Illegal dissolution of a major opposition party;
- Refusal to comply with the terms of the Act for the establishment of a biometric voter registration;
- Renewal of a relative of the President of the Republic at the head of the Constitutional Court;
- Untimely use of armed forces of second and third category;
- Systematic repression of any peaceful demonstration;
- Arbitrary imprisonment of striking students;
- Repeated armed attacks against the private television channel TV +;
- Stalking of uncompromised journalists;
- Systematic suspension of media deemed too critical;
- Interference with the freedom to come and go of many members of the Opposition;
- Dismissal of all senior officials of the civil service believed to be close to the Opposition;

DEMOCRACY IS PROVING TO BE AN IMPERATIVE FOR GABON’S STABILITY

The true source of the multifaceted crisis affecting Gabon is the illegitimacy of the current regime. As long as political leaders will not be anointed by popular and democratic legitimacy, the situation will continue to deteriorate. The bankruptcy of Gabonese democracy is characterized by:
- Poor organization of elections;
- The systematic manipulation of the electoral list;
- The manufacture and use of false civil status documents, to allow multiple voting;
- The use of physical and psychological violence;
- The involvement of partisan civil service authorities in the expression of universal suffrage;
- The purchase of votes;
- The permanent fueling of tribalism, which is to say ethnic isolationism that undermines national unity and social cohesion.

More than ever, the Gabonese are convinced that the current system no longer offers any possibility of democratic transparency. More than ever, many social forces are contemplating the idea that the use of violence is the only recourse for political change in Gabon.

To avoid a leap into the unknown, the Civil Society considers it urgent to open inclusive talks with all forces of the Nation. This is the meaning of its support for the idea of a Sovereign National Conference. This forum could avoid the worst and initiate a national debate concerning in particular:
- Methods and conditions for amending the Constitution,
- Return to elections with two rounds;
- Limiting the number of terms;
- Reform of the Constitutional Court;
- Reform of the National Council of Communication;
- The revision of the Autonomous and Permanent National Electoral Commission;
- Clarification of the powers of the President of the Republic;
- Neutrality and autonomy of the civil service;
- Redistricting and demographic;
- Reform of the Republican Guard;
- Redefining the relationship between the army and the people in times of crisis.

The Gabonese Civil Society reaffirms that its struggle is civic and democratic.

PANORAMA DE LA SITUATION SOCIO-POLITIQUE AU GABON

Depuis le décès du Président Omar Bongo Ondimba le 08 juin 2009 et le scrutin anticipé d’août 2009, le climat socio-politique au Gabon n’a cessé de se dégrader du fait de la volonté clairement exprimée du Parti Démocratique Gabonais (PDG, au pouvoir) de confisquer le pouvoir et imposer une vision monarchique au mépris des règles de l’État de droit et de la souveraineté du peuple gabonais. L’ensemble des forces vives du Gabon n’a eu de cesse de tirer la sonnette d’alarme quant aux risques majeurs que cette situation fait courir au pays. Le refus du PDG de se plier au respect des règles du jeu démocratique se manifeste à travers la mauvaise organisation de toutes les élections. Avec un taux de participation de moins de 15%, les législatives de décembre 2011 n’ont pas dérogé à cette règle. Bien au contraire, elles se sont soldées par la mise en place d’une assemblée nationale monocolore où sur cent vingt (120) députés, le PDG compte à lui seul 114.

LA SITUATION POLITIQUE, ÉCONOMIQUE ET SOCIALE DU GABON CONTINUE DE SE DÉGRADER

Exerçant par délégation la souveraineté nationale, la Cour Constitutionnelle s’est, depuis bientôt trois (3) ans, illustrée avec un zèle rarement atteint par des interprétations spécieuses et partisanes du Droit en vue de favoriser le contrôle du Pouvoir et de l’appareil d’État par le PDG. La Cour Constitutionnelle s’est comportée comme un organisme spécialisé du PDG en validant, deux mois avant les dernières législatives, une Loi qui fait obligation à tout dissident voulant se porter candidat à une élection, de se prononcer six (6) mois à l’avance. En validant une loi qui dispose que les dirigeants d’un parti dissout ne peuvent en créer un autre avant cinq (5) ans, elle a délibérément pris le parti de priver certains compatriotes de leurs droits politiques et d’écarter de la compétition toute personne gênante pour le PDG. La reconduction, pour un quatrième mandat de sept (7) ans de Mme Mborantsuo, par ailleurs belle-mère de M. Ali Bongo, à la tête de cette Institution n’augure rien de bon quant à l’enracinement des valeurs démocratiques et à la sincérité des prochains scrutins.
Les observateurs de la vie politique et l’ensemble de la population gabonaise qui s’interrogeaient déjà avec gravité sur la capacité de ce pouvoir à bien gouverner sont désormais convaincus que le Gabon n’est pas gouverné, mais pris en otage par un clan qui compromet sérieusement son avenir. Les principales mesures prises par le Pouvoir vont dans le sens de sa personnalisation et de la négation des principes démocratiques.

- Révision unilatérale de la Constitution pour renforcer les pouvoirs du Président de la République ;
- Dissolution illégale d’un des principaux parti d’opposition ;
- Refus de se conformer aux termes de la Loi quant à la mise en place d’un fichier électoral biométrique ;
- Reconduction d’un membre de la parentèle du Président de la République à la tête de la Cour constitutionnelle ;
- Usage intempestif des forces de deuxième et troisième catégorie ;
- Répression systématique de toute manifestation pacifique ;
- Emprisonnement arbitraire d’étudiants grévistes ;
- Attaques armées répétées contre la chaîne de télévision privée TV+ ;
- Traque de journalistes insoumis ;
- Suspension systématique de media jugés trop critiques ;
- Entrave à la liberté d’aller et venir de nombreux membres de l’Opposition ;
- Limogeage de tous les hauts cadres de l’Administration soupçonnés d’être proches de l’Opposition ;

LA DÉMOCRATIE SE RÉVÈLE UNE IMPÉRIEUSE NÉCESSITÉ POUR LA STABILITÉ DU GABON

La source véritable de la crise multiforme que traverse le Gabon est le caractère illégitime du pouvoir actuel. Tant que les dirigeants politiques ne seront pas oints de la légitimité populaire et démocratique, la situation continuera à se dégrader. La faillite de la démocratie au Gabon se caractérise par :
- La mauvaise organisation des élections ;
- La manipulation systématique de la liste électorale ;
- La fabrication et l’utilisation de faux documents d’Etat-civil pour permettre des votes multiples ;
- L’usage de la violence physique et morale ;
- L’implication partisane des Autorités administratives dans l’expression du suffrage universel ;
- L’achat des consciences ;
- L’incitation permanente au tribalisme, c’est-à-dire au repli identitaire qui met à mal l’unité Nationale et la cohésion sociale.

Plus que jamais, les Gabonais sont convaincus que le système actuel n’offre plus aucune possibilité de transparence démocratique. Plus que jamais, de nombreuses forces sociales se laissent aller à l’idée que l’usage de la violence est le seul recours pour une alternance politique au Gabon.

Pour éviter un bond dans l’inconnu, la Société Civile estime qu’il est urgent d’ouvrir des pourparlers inclusifs avec l’ensemble des forces vives de la Nation. C’est le sens de son soutien à l’idée de Conférence Nationale Souveraine. Ce forum pourrait permettre d’éviter le pire et d’engager une réflexion nationale portant notamment sur :
- les modes et les conditions de révision de la Constitution,
- le retour au scrutin à deux tours ;
- la limitation du nombre de mandats ;
- la réforme de la Cour Constitutionnelle ;
- la réforme du Conseil National de la Communication ;
- la refonte de la Commission Electorale Nationale Autonome et Permanente ;
- la clarification des pouvoirs du Président de la République ;
- la neutralité et l’autonomie de l’administration :
- le découpage électoral et le poids démographique ;
- la réforme de la Garde Républicaine;
- la redéfinition du rapport entre l’armée et le peuple en période de crise.

La Société civile Gabonaise réaffirme que son combat est citoyen et démocratique.
