This Friday, January 24, 2014, Ali Bongo announced the firing of Raymond Ndong Sima and the appointment as Prime Minister of Daniel Ona Ondo who had been until then Senator. The first reaction of this blog regarding this replacement is that once again, independent newspapers have demonstrated their perfect reading of the political landscape of Gabon; because before anyone else, these newspapers announced months ago that Raymond Ndong Sima’s fate was sealed, a situation highlighted by the many humiliations the Prime Minister had suffered at the hand of those near Ali Bongo, the head of them being Maixent Accrombessi, his Chief of Staff.


But in Gabon, things are never really handled as they are elsewhere, in the sense that almost everywhere else, if the measures of individual appointment obviously fall within the constitutional authority of the President of the Republic, the general announcement of appointment of a Prime Minister obeys a carefully measured and choreographed procedure which is executed with elegance and tact. But we are in Gabon where elegance, tact and decorum rules do not apply to the Bongo regime.


The Gabon got its Constitution and its operation from the French model and in Article 8 of the Constitution of the Fifth French Republic, one can read:


"The President of the Republic appoints the Prime Minister. He terminates their functions on the presentation by them of the Government's resignation. On the proposal of the Prime Minister, he appoints the other members of the Government and terminates their appointments. "


What does this mean?


As a general rule, the appointment of a new Prime Minister should be a posteriori to the presentation by letter of the resignation of a current Prime Minister. The elegance of the procedure therefore dictates that in normal times, apart from a serious constitutional or state crisis, the President cannot dismiss the Prime Minister; the process is that the Prime Ministers resigns, the President accepts the resignation subjected constitutionally to the resignation of the government. It is the delivery of this letter of resignation that terminates the Prime Minister’s functions. Where are we in Gabon?


In making the appointment of a new Prime Minister, without offering to Raymond Ndong Sima the protocol of an honorable and graceful exit, did Ali Bongo want in his way, once again, to show to Raymond Ndong Sima that he was the only leader on board? Was it a way to flex his muscles and play machoman to tell the Gabonese people that makes and breaks whomever he wishes, while ignoring advice and procedures? For this blog, this approach looks like a big kick in the backside of Raymond Ndong Sima by the Presidential Cabinet. This is so for us a revocation of the Prime Minister, nothing more and nothing less.


We simply note that this new episode should serve as a lesson to those who claim to be for Ali Bongo and who instead of worrying about the well-being of ordinary Gabonese citizens, make noise because they protect, to paraphrase Gregory Ngbwa Mintsa, a small piece of bread. Yesterday it was Paul Mba Biyoghe who was fired after three years, today it is Raymond Ndong Sima after 2 years, how long it will be for Daniel Ona Ondo before the fatal blow off? Three Prime Ministers in 4 years, it is a world record, the “emergence” is going well ...

Ce Vendredi 24 Janvier 2014, Ali Bongo a fait annoncer le remerciement de Raymond Ndong Sima et la nomination au poste de Premier Ministre de Daniel Ona Ondo qui était jusque-là Sénateur. La première réaction de ce blog à ce remplacement est qu’encore une fois, les journaux indépendants ont démontré leur parfaite lecture du paysage politique Gabonais, car avant tout le monde, ces journaux annonçaient depuis des mois que le sort de Raymond Ndong Sima était scellé, situation mise en évidence par les nombreuses humiliations que lui faisaient subir les proches d’Ali Bongo, en tête desquelles Maixent Accrombessi, son Directeur de Cabinet.


Mais au Gabon, les choses ne sont jamais vraiment faites comme ailleurs, en ce sens que partout ailleurs ou presque, si les mesures de nomination individuelles relèvent évidemment de la compétence constitutionnelle du Président de la République, en général l’annonce du décret de nomination d’un Premier Ministre obéît à une procédure millimétrée et chorégraphiée avec élégance et tact. Mais nous sommes au Gabon où l’élégance, le tact et les règles de bienséances ne s’appliquent pas au régime Bongo.


Le Gabon calque sa constitution et son mode de fonctionnement sur la France et dans l’Article 8 de la Constitution de la Cinquième République française on lit ceci:


«Le Président de la République nomme le Premier Ministre. Il met fin à ses fonctions sur la présentation par celui-ci de la démission du Gouvernement. Sur la proposition du Premier ministre, il nomme les autres membres du Gouvernement et met fin à leurs fonctions.»


Qu’est-ce que cela signifie?


Qu’en règle générale, la nomination d’un nouveau Premier Ministre devrait se faire a posteriori de la présentation par lettre de la démission du Premier Ministre en Exercice. L’élégance voudrait donc qu’en temps normal, en dehors d’une grave crise constitutionnelle ou étatique, le Président ne puisse pas renvoyer le Premier Ministre; la formule voulant que les premiers ministres démissionnent, que le Président accepte cette démission assujettit constitutionnellement a la démission du gouvernement; c'est la remise de cette lettre de démission qui met fin aux fonctions de Premier Ministre. Où en sommes-nous au Gabon?


En procédant à la nomination d’un nouveau Premier Ministre, sans offrir à Raymond Ndong Sima le protocole d’une sortie honorable et élégante, Ali Bongo a-t-il voulu à sa manière, encore une fois, signifier à Raymond Ndong Sima, qu’il était le seul chef à bord? Est-ce une façon de bomber le torse et jouer les machos pour dire aux gabonais qu’il fait et défait les gens sans tenir compte des avis et des procédures? Pour ce blog, cette façon de faire ressemble à un grand coup de pied dans l’arrière train de Raymond Ndong Sima, par le Cabinet présidentiel. Il s’agit donc pour nous, d’une révocation de Premier Ministre, sans autre forme de procès.


Nous retenons simplement que cet autre épisode devrait servir de leçon à ceux qui se réclament d’Ali Bongo et qui au lieu de se préoccuper du bien-être du commun des gabonais, font du bruit parce qu’ils protègent, comme dirait Gregory Ngbwa Mintsa, un petit bout de pain. Hier ce fut Paul Biyoghe Mba qui fut congédié après trois ans, aujourd’hui c’est Raymond Ndong Sima après 2 ans, combien de temps mettra Daniel Ona Ondo avant le coup de pied fatal? Trois Premiers Ministres en 4 ans, c’est un record mondial; l’émergence va bien…
