WHO COULD SUSPECT THE CENAP OF BEING REPUBLICAN? QUI POURRAIT SOUPÇONNER LA CENAP D’ÊTRE RÉPUBLICAINE?

Article 7 of the Electoral Code of Gabon:

The preparation, organization and administration of elections are respectively incumbent on the administration, under the authority of the Minister of the Interior, the Autonomous and Permanent National Electoral Commission, abbreviated CENAP.

Article 10 of the Electoral Code of Gabon:

Is created an Autonomous and Permanent National Electoral Commission, abbreviated CENAP, which is charged with the organization and administration of every political election and referendum. It shall ensure, in particular, their proper physical organization and makes the necessary adjustments to any found malfunction. The Autonomous and Permanent National Electoral Commission has its headquarters in Libreville. It enjoys budgetary management autonomy.

Article 14 of the Electoral Code of Gabon:

The Autonomous and Permanent National Electoral Commission shall: ... receive and examine the candidacy files for presidential, parliamentary, senatorial, municipal and departmental elections... Complete archiving of all electoral documents.

Article 16 of the Electoral Code of Gabon:

Before taking office, the officers of the Autonomous and Permanent National Electoral Commission and of the offices of local and consular commissions, take the following oath before the Constitutional Court: "I swear to fulfill the duties of my office with honesty and impartiality, to respect and enforce the electoral law, the universal suffrage, pluralist democracy and subject myself to the secrecy of the proceedings in which I have taken part in the exercise of my duties."

Dear readers, by barricading their facility and fading in nature, all this on Monday, 18 July 2016, the President of the CENAP, Mr. Aboghe-Ella and his team, have violated the above articles of the Electoral Code of Gabon. Contrary to what the regime says of the role of the CENAP, Gabonese jurisprudence texts provide that the CENAP must not only receive the candidacy files, but also examine them to ensure that they comply.

In fleeing their responsibility to inform the public upstream, of the good organization of the elections, by closing their offices to members of the opposition so they could not verify the authenticity of the new birth certificate that Ali Bongo has introduced; Mr. Aboghe-Ella and his team have seriously violated the oath they took on the Gabonese Constitution to perform their duties with integrity and impartiality. By preventing the opposition to confront the birth certificate of 2009 to that of 2016, it is clear that the CENAP wants to protect Ali Bongo, which is a departure from our constitution.

The CENAP is outlaw; the CENAP has demonstrated its partiality, the CENAP cannot organize the presidential election in August 2016 because it is not Republican.

Article 7 du Code Electoral du Gabon :

La préparation, l’organisation et l’administration des élections incombent respectivement à l’administration, sous l’autorité du Ministre chargé de l’Intérieur, et à la Commission Electorale Nationale Autonome et Permanente, en abrégé CENAP.

Article 10 du Code Electoral du Gabon:

Il est créé une Commission Electorale Nationale Autonome et Permanente, en abrégé CENAP, à laquelle sont codifiées l’organisation et l’administration de chaque élection politique et référendaire. Elle veille, en particulier, à leur bonne organisation matérielle et apporte les correctifs nécessaires à tout disfonctionnement constaté. La Commission Electorale Nationale Autonome et Permanente a son siège à Libreville. Elle jouit de l’autonomie de gestion budgétaire.

Article 14 du Code Electoral du Gabon:

La Commission Electorale Nationale Autonome et Permanente est chargée de:… Recevoir et examiner les dossiers de candidature aux élections présidentielles, législatives, sénatoriales, municipales et départementales… Procéder à l’archivage de tous les documents électoraux.

Article 16 d du Code Electoral du Gabon:

Avant leur entrée en fonction, les membres du Bureau de la Commission Electorale Nationale Autonome et Permanente et ceux des bureaux des commissions locales et consulaires prêtent le serment suivant devant la Cour constitutionnelle : « je jure d’accomplir les devoirs de ma charge avec probité et impartialité, de respecter et de faire respecter la loi électorale, le suffrage universel, la démocratie pluraliste et de m’astreindre au secret des délibérations auxquelles j’aurais pris part dans l’exercice de mes fonctions ».


Chers lecteurs, en faisant barricader leur locaux et s’évanouissant dans la nature, tout ceci le Lundi 18 Juillet 2016, le président de la CENAP, Monsieur Aboghe-Ella et son équipe, ont violé les articles ci-dessus du Code Electoral Gabonais. En effet, contrairement à ce que dit le pouvoir concernant le rôle de la CENAP, les textes de jurisprudence du Gabon prévoient que la CENAP doive non seulement recevoir les dossiers de candidature, mais aussi et surtout de les examiner pour s’assurer qu’ils soient conformes.

En fuyant leur responsabilité consistant à informer le public en amont, de la bonne organisation des élections, en fermant leurs bureaux pour que les membres de l’opposition ne puissent vérifier l’authenticité du nouvel acte de naissance que vient d’introduire Ali Bongo; Monsieur Aboghe-Ella et son équipe, ont gravement violé le serment qu’ils ont fait devant la Constitution Gabonaise d’accomplir leur mission avec probité et impartialité. En empêchant l’opposition de confronter l’acte de 2009 à celui de 2016, il est clair que la CENAP veuille protéger Ali Bongo, ce qui est une entorse à notre constitution.

La CENAP est hors la loi ; la CENAP a démontré sa partialité, la CENAP ne peut organiser l’élection présidentielle d’aout 2016 car elle n’est pas républicaine.

  1. Maintenant que prévoit la loi dans ce genre situation? Et MBOURANTSOUO a-t-elle été saisie pour lui faire constater cela?

  2. La CENAP est un organe supposé républicain et qui ne saurait s’interdire à l’opposition. Elle est en violation de ses propres textes. Quand a Mborantsuo, je crois savoir qu’elle ait été saisie pour constater, mais vu son historique, toute réaction de sa part me surprendrait.
