There are enlightened people who tell us that the arrest of trade unionist Simon Ndong Edzo is justified on the grounds that since he is retired, he should no longer have the right to participate in union activities.

These people must know and understand that retiree does not lose the status of trade unionist. In labour law, which is governed by international conventions, a worker who retires may well remain a member of their union; and, by extension, maintain their right to participate in the activities of the organization.

Freedom to demonstrate is a fundamental right. Prohibiting a person from demonstrating on the pretext that they are retired is an infringement of their freedom. Retirees even often play a crucial role in the transmission of experience and advice within trade union structures. Their presence during demonstrations is therefore not only authorized, but often encouraged to strengthen the movement.

There is no internationally recognized legal provision that would specifically prohibit a retiree from joining a union demonstration. On the contrary, trade unionism is a commitment that can continue beyond working life.

Lech Wałęsa, the famous Polish trade unionist and founder of the Solidarność union is one of the few trade unionists to have reached the top of the state (President of the Republic). But after his presidential term and despite his advanced age, he continued to get involved in the public and trade union debate. Even officially retired, he remained an active voice widely listened to within Solidarność and on the international scene for the defense of workers’ rights and democracy.

Il y a des illuminés qui nous disent que l’arrestation du syndicaliste Simon Ndong Edzo est justifiée au motif que puisque retraité, il n’aurait plus le droit de participer aux activités syndicales.

Ces gens doivent savoir et comprendre que le statut de retraité ne fait pas perdre la qualité de syndicaliste. Dans le droit du travail, qui est régi par des conventions internationales, un travailleur qui part à la retraite peut tout à fait rester membre de son syndicat; et, par extension, maintenir son droit de participer aux activités de l'organisation.

La liberté de manifester est un droit fondamental. Interdire à une personne de manifester sous prétexte qu'elle est retraitée est une atteinte à cette liberté. Les retraités jouent même souvent un rôle crucial de transmission d'expérience et de conseil au sein des structures syndicales. Leur présence lors des manifestations est donc non seulement autorisée, mais souvent encouragée pour renforcer le mouvement.

Il n’y a aucune disposition légale reconnue internationalement, qui interdirait spécifiquement à un retraité de se joindre à une manifestation syndicale. Au contraire, le syndicalisme est un engagement qui peut se poursuivre au-delà de la vie active.

Lech Wałęsa, le célèbre syndicaliste Polonais et fondateur du syndicat Solidarność est l'un des rares syndicalistes à avoir atteint le sommet de l'État (Président de la République). Mais après son mandat présidentiel et malgré son âge avancé, il a continué à s'impliquer dans le débat public et syndical. Même officiellement retraité, il est resté une voix active très écoutée au sein de Solidarność et sur la scène internationale pour la défense des droits des travailleurs et de la démocratie.
